§ 58-4. Assessment lists; assessment book.

  • Upon completion of any improvements authorized under this chapter, or upon the completion of any part, section or parcel thereof, the city council shall cause to be prepared a roll or list, to be called the "Assessment List," showing the names of the property owners in the part completed, whether the entire improvement or a part, section or parcel thereof, and opposite such name a description of each lot or parcel of land proposed to be assessed for such improvement and the amount proposed to be assessed against each lot or parcel of land. Such lists as are from time to time made shall be entered in a book to be prepared for that purpose, which shall contain an appropriate column in which payments may be credited. The book shall be known as the "Assessment Book for Local Improvements." It shall be a public record and the entry therein of any assessment shall be and constitute notice to the public of the lien against the land so assessed, and no other record or notice thereof shall be necessary to any person for that purpose. No error, omission or mistake in regard to the name of the owner shall be held to invalidate any assessment. The assessment book shall be kept in the office of the city clerk, and, as fast as any assessment list has been made, whether the assessment list shall cover a complete improvement under one contract or project or a portion of the improvement as completed for that part, section or parcel thereof, it shall be delivered to the city clerk, who shall thereupon publish the list once a week for two weeks in some newspaper published in the city, together with a notice that, at the time and place mentioned in the notice, not less than 15 days from the date of first publication, the city council will meet to hear and determine any objections or defense that may be filed to such assessments or the amount thereof. Such notices shall also state the general character of the improvements, the terminal points thereof, and the streets, highways, boulevards, avenues, squares, lanes, alleys and parks or portions thereof on which the improvement has been completed.
