§ 58-5. Method of apportionment.

  • Assessments under this chapter shall be made and apportioned as the city council may determine. The city council may direct that the cost and expense of the improvements authorized by this chapter shall be apportioned as follows: The whole or such part of the cost of the improvement as the city council may fix may be assessed upon property specially benefited by the improvement in proportion to the benefit to be derived therefrom, and special benefits to be determined and prorated according to the front footage of the respective properties specially benefited by the improvement. The apportionment of such cost and expense may be made by such other method as the city council may prescribe. If the city council shall find that all property in due proximity to such improvement as provided in section 58-3 is specially benefited, it may direct that the whole or such part of the cost thereof as it shall fix be assessed against the property by reason of the benefit by the improvement.
